CAR RENTAL AGREEMENT

 

This Car Rental Agreement (the "Agreement") is made and entered into between Brains Car Rentals Partnering with Everything Nice LLC, located in Lanham, Maryland (hereinafter referred to as the "Rental Company"), and the undersigned customer (hereinafter referred to as the "Renter"), as of the date of signing this Agreement.

**ATTENTION:** ANY DEPOSIT MADE WILL ONLY BE REFUNDED 21 DAYS AFTER VEHICLE IS RETURNED. ALL OUR VEHICLES ARE EXCLUSIVELY LIMITED TO DC, MD AND VA.  **IF YOU ARE LEAVING THE DMV YOU MUST NOTIFY US BY TEXT OR CALL FIRST**. If you need more information on this, please ask our representatives. Also, please refuel the vehicle to the same fuel level as when you took it before returning, or you will be billed for the difference. ||| If you are renting with us for more than one week, a complimentary car wash is required every Saturday as part of our sanitation policy. We kindly ask that you send photo confirmation via text after each wash.|||

By choosing to rent with us, you grant us the full authority to report any rental violations to car rental corporations and associations across the DMV, as well as to transportation agencies and motor vehicle dealerships.

Tenga en cuenta que el depósito que realizó se le reembolsará SÓLO después de 21 días a partir de la fecha en que devolvió el vehículo. Si tiene multas por exceso de velocidad o incumplimientos de la cámara de luz roja o cualquier reclamo del estado o federal o si no cumple con nuestros Términos y condiciones ACORDADOS, estos fondos se destinarán a cubrir eso y, si se requiere más, se le facturará.

**POLÍTICA DE NO FUMAR DE BRINS CAR RENTALS**


At Brains Car Rentals, we take our commitment to providing a clean and smoke-free environment seriously. We have a strict non-smoking policy in place to ensure the well-being and comfort of all our customers. By signing our Non-Smoking Agreement, you are acknowledging and agreeing to the following terms:

1. **Zero Tolerance for Smoking:**
   - Smoking of any kind, including but not limited to cigarettes, cigars, pipes, electronic cigarettes, and other forms of tobacco or recreational smoking, is strictly prohibited in our rental cars.

2. **Non-Smoking Agreement Acknowledgment:**
   - By signing the Non-Smoking Agreement, you acknowledge that you have read, understood, and agree to abide by our non-smoking policy throughout the duration of the rental period.

3. **Detection and Consequences:**
   - Brains Car Rentals employs advanced technology and thorough inspection processes to detect any evidence of smoking in our vehicles.
   - In the event that smoking is detected, a non-negotiable automatic charge of $500 will be applied to cover the costs of cleaning and restoring the vehicle to a smoke-free condition.

4. **Legal Consequences:**
   - Non-compliance with the non-smoking policy may result in legal action. Should the $500 charge remain unpaid, Brains Car Rentals reserves the right to pursue legal action in a court of law to recover damages.
   - By signing the Non-Smoking Agreement, you expressly waive any right to resist legal action and acknowledge that you are solely responsible for the consequences, including associated legal costs.

5. **Assumption of Responsibility:**
   - By renting a vehicle from Brains Car Rentals, you accept full responsibility for ensuring that neither you nor any passengers smoke in the rented vehicle during the rental period.
   - Brains Car Rentals is not responsible for identifying or verifying individuals who may have smoked in the vehicle during or after the rental period.

We appreciate your cooperation in maintaining a smoke-free environment for all our customers. Your signature on the Non-Smoking Agreement signifies your understanding and acceptance of these terms.
