Brains Car Rentals has put forth significant effort to clearly outline its privacy policies so that our valued customers can fully understand how Brains Car Rentals handles the collection, use, disclosure, and exchange of information in all of its locations. When You Contact Brains Car Rentals to Rent a Car:
- We will collect your personal information such as your name, address, phone number, and email.
- Driver's license information, including date of birth, will be collected and a copy of your driver's license will be either photographed by our company phone or scanned at any of our offices. This information will be stored in our system.
- We may also collect and store your insurance information, passport (for visitors to the US and Canada), proof of residence, personal references, and credit card information when necessary.
Your Health:
- A Brains Car Rentals representative may inquire about important medical issues, including allergies, to better assist in making informed decisions regarding adaptive driving devices or necessary waivers.
Use of Bluetooth and GPS:
- Our fleet consists of modern cars equipped with systems and applications provided by various car manufacturers, which allow for the pairing of your phone or other devices with the rented vehicle.
- If you pair a mobile device with the navigation or infotainment system in our vehicles, please be aware that these systems utilize third-party software or services.
- Brains Car Rentals cannot be held liable if your personal information and other data are transferred from your mobile device and stored on these systems.
- To ensure privacy and confidentiality, it is advised to delete all personal information and data from these systems before returning the vehicle to prevent subsequent occupants from accessing such information.
Abandonment, Non-Communication, and Vehicle Recovery Clause
In the event that the Customer ceases communication, fails to respond to outreach attempts, abandons the rental, or defaults on any required payments, the Company reserves the absolute and unilateral right to initiate immediate recovery actions.
The Customer expressly authorizes the Company, its agents, contractors, or designated field operations personnel to locate, access, secure, and recover the rented vehicle at any time and at the Company’s sole discretion. The Company shall not be obligated to provide prior notice of the date, time, or manner of such recovery operations.
The Customer acknowledges and agrees that any failure to maintain active communication or remain current on payments constitutes a material breach of the rental agreement and may result in repossession without further notice.
In the event of repossession or recovery, the Company shall not be held liable or responsible for any personal property, valuables, or items of any kind left inside the vehicle. All such items shall be deemed abandoned.
By entering into this agreement, the Customer expressly waives any and all claims against the Company, its affiliates, agents, or representatives for loss, damage, or disposal of personal property remaining in the vehicle at the time of recovery.
The Company further reserves the right to take any additional actions permitted under applicable law to recover the vehicle and any outstanding balances owed.
Sharing of Your Personal Information:
- Brains Car Rentals may share your personal information with service providers, state or federal agencies, if legally compelled to do so.
- We may share your information with insurance replacement providers, as well as providers assigned by Brains Car Rentals for customer research or satisfaction surveys.
- Information may be shared with agencies responsible for traffic regulations, law enforcement agencies, and collection agencies for unpaid bills to avoid liability for incurred penalties.
- All Brains Car Rentals offices are equipped with CCTV cameras, and in some cases, our representatives may wear body cameras for the safety of customers, staff, premises, and vehicles.
- Address, identity, and verification providers may receive your information to protect our business against individuals attempting to use fake identification documents.
- Customer support providers, call center operators, receptionists, live chat facilitators, and other customer service facilitators at Brains Car Rentals will have access to your information.
- Communication providers such as T-Mobile may receive your information to facilitate text messages, phone calls, emails, digital marketing, and other communications on our behalf.
- Information may be shared with auto shops, insurance carriers, claim processors, and related partners to facilitate vehicle repairs.
- Vehicle recovery agents, including tow truck companies, will also have access to such information.
- Information may be shared with our insurance carrier(s), roadside assistance providers, and repair agencies.
- Banks and merchant machine providers may be provided with your information.
- Information may be shared with the MVA, law enforcement, and law offices for payment, collection, and credit reporting purposes to aid in collecting payment from delinquent customers.

Acknowledgment of Reporting System Consent and Waiver of Rights
By signing this agreement and renting from us, you acknowledge and accept that:
1. We maintain a centralized reporting system that tracks violations of our rental agreements.
2. This reporting system exists solely to collect data on breaches of our rental terms and to identify individuals who may be restricted from future rentals to ensure legal compliance and maintain business integrity.
3. In the event of a violation of this rental agreement, you consent to the reporting of such violations in our centralized system, which may include personal information such as names, contact details, and driver’s license information.
4. You expressly waive the right to contest the validity of this reporting system and the use of your personal information in this context in any court of law.
By signing and renting from us, you affirm your understanding and acceptance of these terms.
